These Terms and Conditions govern your use of edmontonpetphotography.com and the photography services provided by Edmonton Pet Photography, operated by Eric Newby (“Photographer”), Edmonton, Alberta, Canada. By booking a session or using this website, you agree to these terms.

The Service

Edmonton Pet Photography offers outdoor pet portrait photography sessions in and around Edmonton, Alberta. Session types, pricing, and availability are described on the website and confirmed at the time of booking.

Booking and Payment

The full collection price is payable at the time of booking, processed securely through Stripe; we accept major credit and debit cards. Your session date is not held until payment has been received and processed. A non-refundable booking fee equal to 25% of the collection price forms part of this payment and reserves your date; see Cancellation and Rescheduling below for how refunds are handled.

Cancellation and Rescheduling

Weather: Sessions may be rescheduled at no charge if weather conditions are unsuitable for outdoor photography. We will reach out in advance of your session to discuss options and confirm conditions.

Client-Requested Cancellation or Rescheduling

How payment works. The full collection price is paid at the time of booking. Of this amount, a non-refundable booking fee equal to 25% of the collection price reserves your session date and compensates for scheduling, pre-session planning, preparation, and the time held exclusively for you, during which other work is declined. The remaining amount is refundable only as described below.

Rescheduling (preferred).If you need to change your date, we will always try to accommodate a reschedule before treating the change as a cancellation. With at least 7 days' notice, you may reschedule once at no additional charge, and your full payment carries over to the new date. A reschedule requested with less than 7 days' notice, or a second reschedule of the same booking, may be treated as a cancellation under the schedule below.

Cancellation before the session.

Within 48 hours of booking, provided the session is more than 7 days away: full refund of all amounts paid, including the booking fee.
More than 30 days before the session: refund of all amounts paid, except the non-refundable booking fee.
8–30 days before the session: refund of 50% of amounts paid above the booking fee; the booking fee is non-refundable.
7 days or fewer before the session: no automatic refund. Amounts paid may be applied as credit toward a future session booked within 12 months. In exceptional circumstances, including the loss of your pet, we may instead offer a partial or full refund at our discretion.

After the session, before delivery. Once your session has taken place, production has begun and the collection price is non-refundable. If a technical failure on our end (for example, equipment or file failure) prevents me from delivering usable images, we will, at no additional charge, either re-shoot the session at a mutually agreed time or refund the amounts paid above the booking fee.

After delivery. All digital files and printed or finished products are custom-made to your order and are non-refundable once delivered. If a delivered product arrives damaged, defective, or materially different from what was ordered, we will repair, reprint, or replace it at no charge, provided you notify us within 14 days of delivery.

Payment processing fees. Any refund issued under this section is calculated on the amount you paid, less the non-refundable payment-processing fee charged on the original transaction, which our payment processor does not return. This deduction does not apply where we cancel the session (see Photographer Cancellation), in which case you are refunded in full.

Photographer cancellation: In the rare event that we must cancel your session, you will receive a full refund of all amounts paid.

Copyright and Image Ownership

All photographs created during your session are the intellectual property of Edmonton Pet Photography. Upon receipt of full payment, you receive a non-exclusive personal-use license to the edited images delivered to you.

This license permits:

Printing and displaying photos for personal, non-commercial use
Sharing on personal social media with credit to Edmonton Pet Photography

This license does not permit:

Commercial use, advertising, or resale of the images
Submission to stock photo agencies
Removal or alteration of embedded metadata

Model Release

By booking a session, you grant Edmonton Pet Photography permission to use photographs from your session in our portfolio, on our website, and on social media. If you prefer your images not be used for promotional purposes, please let us know in writing before your session.

Image Delivery

Preview galleries are typically ready within 7 to 10 business days after your session. The number of images delivered depends on the session type and conditions on the day.

Final retouched images and finished artwork are completed after image selection and artwork ordering. Most finished orders are delivered within approximately three to four weeks of the session date, depending on selection timing, product type, print production, and shipping.

Limitation of Liability

Photography sessions take place outdoors with live animals. Edmonton Pet Photography is not liable for any injury to people or pets, or for any loss or damage arising from circumstances beyond our reasonable control, including weather, unexpected animal behavior, or third-party location restrictions. Our total liability to you shall not exceed the total fees paid for your session.

Electronic Communications Under CASL

By submitting a contact inquiry or completing a booking, you consent to receive a response from us by email. Booking confirmation messages are transactional communications related to your purchase and are sent in compliance with Canada's Anti-Spam Legislation (CASL). We do not send promotional or marketing messages without your separate, explicit consent.

Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta and the applicable laws of Canada. Any disputes will be resolved in the courts of Alberta.

Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Updates take effect when posted to this page. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
